Draft Regulations to Prohibit the Blacklisting of Trade Union Members
Summary:
Article 5 of the Employment Relations (NI) Order 1999 contains a power for the Department to introduce Regulations which prohibit the compilation, dissemination and use of trade union blacklists. This document contains draft Regulations for consultation. The Department will amend the draft Regulations following this consultation exercise as appropriate. However, the Regulations will not be brought into effect until there is evidence that individuals or organisations are planning to draw up such lists, or that blacklisting is actually taking place. In order to gauge the Northern Ireland views on the issue of blacklisting, a public consultation document was issued under cover of a note from the Department on 19 March 2003. The document invites comments on enclosed draft Regulations and on the analysis contained in a Regulatory Impact Assessment (RIA). Responses are sought by 11 June 2003.
