High Performance Workplaces - Informing and Consulting Employees
Summary:
In March 2002 the European Commission adopted a Directive on informing and consulting with employees, which by 2008 will impact on all undertakings in the UK with over 50 employees. The Directive must be introduced into NI legislation by March 2005 when it will initially affect organisations with over 150 employees. The Directive will establish a right for employees to be informed about the business’s economic situation, employment prospects and about decisions likely to lead to changes in work organisation or contractual relations, eg redundancies, transfers etc. A discussion paper on the provisions of the Directive (‘High Performance Workplaces: The role of employee involvement in a modern economy’) was issued in both GB and NI last year. The overall response to this paper and the discussions which followed, resulted in an agreement on the framework for implementing the Directive in the UK. Therefore, a public consultation document, containing draft legislative proposals and a UK-wide Regulatory Impact Assessment (RIA) was issued on 12 September 2003. Responses are sought by 28 November 2003. A discussion paper on European Works Councils (EWC) also issued with this document.
